Kakamega Homeboyz FC boss faces legal action from Senator for alleged defamation over comments on a farmhand's death.

Kakamega Homeboyz chairman Cleophas Shimanyula finds himself in a precarious situation as he faces a hefty Ksh200 million compensation demand from Kakamega Senator Boni Khalwale.

The demand arises from allegations of defamatory statements made by Shimanyula on social media which implicated Senator Khalwale in the tragic death of his farmhand, Kizito Amukune Moi.

The controversy began when Shimanyula accused Senator Khalwale of playing a role in the death of Kizito, despite an autopsy confirming the farmhand's demise was due to a bull attack.

In response, Khalwale, through his advocate Danston Omari, initiated legal proceedings demanding Shimanyula to retract his statements and issue a public apology.

“Our instructions are to demand from you that you confirm to us in writing, within the next 48 hours that you shall immediately, but in any event not later than 48 Hours from the date hereof, that you publish an unqualified retraction of all the defamatory statements and an unconditional apology that should achieve similar prominence as the offending scandalous statements,” Khalwale's legal notice stated.

Moreover, Khalwale's legal counsel has made it clear that failure to comply with these demands will result in immediate legal action against Shimanyula, warning of significant financial and legal repercussions.

Despite the looming legal threat Shimanyula remains defiant expressing his readiness to face the challenge head-on even if it means taking the battle to the highest courts.

"I am not intimidated by legal challenges, whether they lead me to The Hague or the Supreme Court. My commitment is to stand firm with the truth and seek justice for the deceased," said Shimanyula.

The controversy has its roots in the mysterious circumstances surrounding the death of Khalwale's farmhand, whose body was discovered on January 28 in a gruesome scene at Khalwale's shed.

The incident has since escalated into a high-profile legal confrontation, with both parties standing their ground.
